To help ensure inquiries are handled accurately, courteously, and promptly, telephone calls between you and McEldrew Purtell (including our affiliates, agents, case managers, paralegals, and/or attorneys) may be monitored and recorded.

By providing a telephone number or email address to us – on our website, by text, by phone, or otherwise- you consent to receive communications from McEldrew Purtell at those contact points. We may place calls and/or send text (SMS/MMS) messages at any number you provide. These communications may use prerecorded/artificial voice and/or an automatic telephone dialing system where permitted by law. Message frequency varies. Message and data rates may apply.

You certify that the numbers you provide are your own and that you are authorized to receive calls and texts at those numbers. You may opt out of text messages at any time by replying STOP. No Attorney‑Client Relationship from Site Use

An attorney‑client relationship with McEldrew Purtell arises only after we confirm that no conflicts exist and both you and the firm execute a written engagement (retainer) agreement.

You represent that you have all rights necessary for your Submissions and that they do not infringe any third‑party rights.


Governing Law; Dispute Resolution

These Terms and any dispute arising from or related to the Site are governed by the laws of the Commonwealth of Pennsylvania, without regard to conflict‑of‑laws rules.

Arbitration Agreement and Class‑Action Waiver. Except for claims that may be brought in small‑claims court, any dispute between you and McEldrew Purtell arising out of or relating to the Site shall be resolved by binding arbitration administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules, in Philadelphia County, Pennsylvania. You and we waive the right to a jury trial and agree that claims may be brought only in an individual capacity and not as a class or representative action. Judgment on the award may be entered in any court of competent jurisdiction.


International Use

The Site is controlled and operated from the United States and is intended for use by persons located in the U.S. We make no representation that the Site is appropriate or available for use outside the U.S.

Other Terms

If any provision of these Terms or our Privacy Policy is found unenforceable, that provision will be enforced to the maximum extent permitted and the remainder will remain in full force and effect. Our failure to act with respect to a breach does not waive our right to act later. No waiver or modification is effective unless in writing. These Terms, together with the Privacy Policy, constitute the entire agreement between you and McEldrew Purtell regarding Site use and supersede prior or contemporaneous communications regarding the Site, except that these Terms do not supersede any engagement agreement between the firm and its clients.

We may, in our sole discretion and without prior notice, block or terminate your access to the Site if we believe you have violated these Terms or used the Site in an unacceptable manner.
